Terms of Service
1. Who we are (operator identification)
The service available at runmygame.eu and panel.runmygame.eu ("RunMyGame", the "Service") is operated by:
52-204 Wrocław, Poland
NIP (Tax ID): PL6681972344 · REGON: 363433999
Registered in the Polish Central Registration and Information on Business (CEIDG)
E-mail: support@runmygame.eu · Discord: discord.gg/runmygame
This section also serves as the legal notice (imprint) for the website. The fastest way to reach us is e-mail; we reply on business days, Monday–Friday, 09:00–18:00 CET.
2. Definitions
- Operator, we, us — the entity identified in section 1.
- Customer, you — the natural or legal person who creates an Account and orders the Service.
- Consumer — a Customer who is a natural person acting for purposes outside their trade or profession.
- Account — your registered account in the Panel.
- Panel — the customer dashboard at panel.runmygame.eu.
- Server — a game server instance we host for you under a Plan.
- Plan — a paid subscription package defined by the supported game and the number of player slots.
3. The Service
RunMyGame provides hosting of private game servers (currently Minecraft; further games may be added). The Service includes provisioning and running your Server, a management Panel, automatic backups, DDoS protection at the infrastructure level, and e-mail notifications about your Server and subscription. Servers are hosted in data centres located in the European Union.
The Service is a digital service within the meaning of EU consumer law. Your Server is normally provisioned automatically within minutes of a successful payment.
4. Account and eligibility
- You must be at least 18 years old and have full legal capacity to create an Account and purchase a Plan.
- Children may play on your Server, but the Account, the contract and the payments belong to you, and you remain responsible for how your Server is used.
- You can register with an e-mail address and password or through Google Sign-In. Keep your credentials confidential; actions performed through your Account are attributed to you.
- The information you provide must be accurate and kept up to date.
5. Orders, prices and payment
- Prices are shown on the website and in the Panel before you order. All displayed prices are total (final) prices; where VAT is applicable, it is included.
- Payments are processed by Stripe. We never receive or store your card number. During checkout Stripe may save your payment method so that renewals can be charged automatically (see section 6).
- The contract is concluded when your payment is confirmed. You will receive an order confirmation and an invoice (issued via Stripe) by e-mail.
- Plans renew at the price applicable when the renewal is charged. We will announce price changes at least 14 days in advance by e-mail; if you do not accept a price change, cancel before the next renewal.
- Plan upgrades take effect immediately; the price difference is settled at the time of the upgrade.
6. Subscription lifecycle, renewals and missed payments
- Plans are subscriptions (monthly or annual) and renew automatically at the end of each billing period using your saved payment method. You can cancel auto-renewal at any time in the Panel with effect from the end of the current paid period — no notice period, no fees.
- If a renewal payment fails, we notify you by e-mail and retry. Your Server keeps running during a grace period of at least 21 days from the missed payment date.
- If payment is still missing after the grace period, your Server is suspended (stopped, data preserved). You can reactivate it by paying at any time while it remains suspended.
- At least 30 days after suspension the Server is removed. Backups of a removed Server are retained for up to 12 months (see section 11), during which we can restore your world on request after payment.
- We may send you reminder e-mails at each stage; these are service messages, not marketing.
7. Right of withdrawal (14 days)
If you are a Consumer (or an entrepreneur treated as a consumer under Polish law), you have the right to withdraw from the contract within 14 days of its conclusion without giving any reason.
Because your Server is provisioned immediately, at checkout you expressly request that we begin performing the Service before the withdrawal period ends. If you then withdraw within 14 days:
- you pay only for the part of the Service already provided — a proportional amount for the days your Server was available;
- we refund the remainder to your original payment method within 14 days of receiving your withdrawal.
To withdraw, send an unequivocal statement to support@runmygame.eu (an e-mail from your Account address with your order number is enough). You may use the model form below, but it is not obligatory:
8. Complaints and statutory warranty
- We are legally obliged to provide the Service in conformity with the contract. Consumers have statutory remedies for non-conformity of digital services under Polish and EU law; these Terms never limit those rights.
- Complaints can be sent to support@runmygame.eu. Please describe the issue and include your Account e-mail.
- We respond to complaints within 14 days.
- Consumers may also use out-of-court dispute resolution: in Poland, assistance is available from municipal/district consumer ombudsmen and the Trade Inspection (Inspekcja Handlowa); details at uokik.gov.pl.
9. Fair use of resources
Plans are sized by player slots, and we do not impose fixed RAM, CPU or storage quotas ("unlimited resources"). This works because resources are shared fairly. We may apply technical limits to a Server whose consumption is grossly disproportionate to its player count and plan — for example due to a misconfigured mod, an abusive workload, or usage unrelated to running a game server for its players — where this is necessary to protect the stability of the platform for other customers. Where practical, we will contact you first.
10. Acceptable use
You must not use the Service to:
- host, store or distribute content that is illegal under Polish or EU law, or that infringes third-party rights;
- run anything other than the game server and its natural companions (mods, plugins, worlds) — in particular no cryptocurrency mining, proxies/VPN exit nodes, or unrelated applications;
- attack, scan or disrupt other systems or networks, send spam, distribute malware;
- attempt to break out of the Server's isolation, interfere with other customers' servers or with our infrastructure;
- resell the Service commercially without our prior written consent (sharing your Server with your friends and community is, of course, what it is for).
We may suspend a Server immediately where it is used in breach of this section or where required by law; we will inform you of the reason unless the law prevents us.
11. Your content, backups and data retention
- The worlds, configurations and other content on your Server are and remain yours. We store and process them only to provide the Service.
- We create automatic backups and keep a limited number of the most recent completed backups per Server. Backups are a safety net, not an archive service — you can also download your data or request an export in the Panel at any time.
- After a Server is removed (see section 6 or termination), its backups are retained for up to 12 months and then permanently deleted. You may request earlier deletion at any time.
- Details of how personal data is handled are in our Privacy Policy.
12. Availability and maintenance
- We aim for high availability and operate monitoring, DDoS protection and daily backups, but the Service is provided on a "best effort" basis: we do not contractually guarantee uninterrupted availability, and availability figures shown on our website are historical measurements, not a promise.
- We may perform maintenance that temporarily interrupts the Service; where planned and significant, we announce it in advance in the Panel or by e-mail.
- None of the above limits your statutory rights if the Service is not in conformity with the contract (section 8).
13. Third-party games
The games you run on your Server (e.g. Minecraft) are third-party products governed by their own licences and terms (e.g. the Minecraft EULA and Usage Guidelines of Mojang/Microsoft). You are responsible for complying with them, including any rules on monetisation of your Server. RunMyGame is not affiliated with, endorsed by or sponsored by Mojang, Microsoft or any other game publisher. All game trademarks belong to their owners.
14. Liability
- Nothing in these Terms excludes or limits our liability for intentional misconduct, for damage caused to life or health, or any other liability that cannot be excluded under mandatory law. Consumers' statutory rights remain unaffected.
- Otherwise, our total liability for damage caused in connection with the Service is limited to the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, and we are not liable for lost profits of business customers.
- We are not liable for failures caused by events beyond our reasonable control (force majeure), including failures of upstream providers, to the extent permitted by law.
15. Termination
- By you: cancel auto-renewal at any time in the Panel (section 6); you may also request deletion of your Account at any time via support@runmygame.eu.
- By us: we may terminate the contract with 30 days' notice to the end of a paid period (in which case unused pre-paid amounts are refunded pro rata), or with immediate effect in the event of a serious or repeated breach of these Terms, in particular of sections 9–10.
- Upon termination, section 11 governs what happens to your data.
16. Changes to these Terms
We may amend these Terms for valid reasons: changes in law, changes to the Service, security requirements, or the addition of new features. We will notify you by e-mail at least 14 days before amendments take effect. If you do not accept the changes, you may terminate the contract free of charge before they take effect; continuing to use the Service after that date constitutes acceptance. The version applicable to you is always available at runmygame.eu/terms/.
17. Governing law, disputes and language
- These Terms are governed by Polish law. If you are a Consumer habitually resident in another EU country, you additionally enjoy the protection of the mandatory consumer-law provisions of that country.
- Disputes with Consumers are subject to the courts having jurisdiction under generally applicable law. Disputes with business customers are subject to the court competent for the Operator's seat.
- These Terms are available in English and Polish. In case of divergence, the English version prevails, except where mandatory consumer law of your country provides otherwise.
- If any provision of these Terms is found invalid, the remaining provisions remain in force.
